Biography: Mr. McHugh has focused on criminal law and civil rights law (including First Amendment law) in state and federal trial and appellate courts. He has represented people from every walk of life, from law enforcement officers to adult bookstore owners to inmates, charged with everything from domestic violence to manslaughter to large scale drug conspiracies. Four of Mr. McHugh's clients have chosen to proceed to jury trial in criminal cases. Three were acquitted on all charges. In 2003, the City of Wichita settled with one of Mr. McHugh's clients in a federal First Amendment case by paying the client over $60,000. In 2004, another client was awarded over $275,000 in a civil rights case after a bench trial in federal district court. Mr. McHugh has argued before the Kansas Court of Appeals, the Kansas Supreme Court, the Missouri Court of Appeals for the Western District of Missouri en banc, and the United States Court of Appeals for the Tenth Circuit. Many of the appellate decisions in cases Mr. McHugh has handled are published and can be found in various reporters or in online databases such as Lexis-Nexis or Westlaw.
